Data protection policy

With the following information pursuant to Articles 13 and 14 GDPR, we would like to provide you with an overview of the processing of your personal data and your rights under data protection law. Which data is processed in detail and how it is used depends largely on the services agreed in each case.

 

1.          Personal data

BergsTopp GmbH collects, processes and uses your personal data only with your consent or mandate or order for the purposes agreed with you or if there is another legal basis in accordance with the GDPR; this in compliance with the provisions of data protection legislation and civil law.

We only collect personal data that is required for the performance and processing of our services or that you have voluntarily provided to us.

Personal data is any data that contains individual information about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender.

 

2.          Use of the data

We will not process the data provided to us for purposes other than those covered by the scope of the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. This excludes the use of data for statistical purposes, provided that the data has been anonymized.

 

3.          Transmission of data to third parties

In order to fulfill your order, it may also be necessary to pass on your data to third parties (e.g. real estate brokers, tax advisors, real estate investors or developers, etc.).

Your data will only be forwarded on the basis of the GDPR, in particular for the fulfillment of your mandate or based on your prior consent.

Some of the recipients of your personal data mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).

 

4.          Information and deletion (data subject rights)

As a client or, more generally, as a data subject, you have the right to obtain information at any time about your stored personal data, their origin and recipients and the purpose of the data processing, as well as the right to rectification, data transmission, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data.

If there are any changes to your personal data, please inform us accordingly.

You have the right at any time to revoke any consent given for the use of your personal data. Your request for information, cancellation, rectification, objection and/or data transfer, in the latter case, provided that it does not involve a disproportionate effort, may be addressed to the address of the company indicated in point 13 of this statement.

If you are of the opinion that the processing of your personal data by us violates applicable data protection law or that your data protection rights have been violated in some other way, you have the option of complaining to the competent supervisory authority. In Austria, this is the Austrian Data Protection Authority.

 

5.          Data security

Your personal data is protected by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, illegal or even accidental access, processing, loss, use and manipulation.

Notwithstanding efforts to maintain a reasonably high level of due diligence at all times, it cannot be excluded that information you disclose to us via the Internet may be viewed and used by others.

Please note that we do not accept any liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hack attack on email account or telephone, interception of faxes).

 

6.          Data breach disclosure

We strive to ensure that data breaches are identified at an early stage and, if necessary, reported to you or the relevant supervisory authority without delay, including the respective categories of data affected.

 

7.          Data retention

We will not retain data longer than is necessary to fulfill our contractual or legal obligations and to defend against any liability claims.

 

8.          Cookies

This website www.bergstopp.com uses “cookies” to make our offer more user-friendly, effective and secure.

A “cookie” is a small text file that we transmit via our web server to the cookie file of the browser on the hard drive of your computer. This enables our website to recognize you as a user when a connection is established between our web server and your browser. In order to optimize this website in terms of system performance, user-friendliness and the provision of useful information about our services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your Internet protocol address (IP address), browser and browser software language, operating system and its interfaces, referrer URL, your Internet service provider, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, the amount of data transferred in each case and the date/time of the request.

This data is not merged with personal data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.

 

10.       Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. In the case of activation of IP anonymization on this website, however, your IP address will be truncated by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area beforehand. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. The IP address transmitted by your browser as part of Google Analytics is not merged with other data from Google.

This website uses Google Analytics with the extension “_anonymizeIp()”. This means that IP addresses are processed in abbreviated form, which means that personal references can be ruled out. 13.       Google Maps

On this website we use the offer of Google Maps. This allows us to show you interactive maps directly in the website and enables you to use the map function comfortably.

By visiting the website, Google receives the information that you have called up the corresponding sub-page of our website. In addition, the data mentioned under points 8. and 9. of this statement are transmitted. This occurs regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not want the assignment with your profile at Google, you must log out before activating the button. Google stores your data as usage profiles and uses them for the purposes of advertising, market research and/or demand-oriented design of its website.
